Immigrant Nail Salon Workers File Overtime Class Action Lawsuit

nail salon worker(LEGAFI) -- A group of immigrant workers at a chain of nail salons in Northern California have filed a class action lawsuit against their employer over alleged illegal work practices that include unpaid overtime, illegally taking tips, and refusing to give lunch breaks.

The Vietnamese nail salon workers, who worked at Natalie Salon locations in San Mateo, Redwood City, Menlo Park, Palo Alto and Los Gatos, allege in the class action lawsuit that they would sometimes work seven days a week without legally mandated overtime pay. They also allege management routinely kept 20 percent of tips left for the workers on credit card payments and didn't allow them to take a lunch break.

According to the Natalie Salon class action lawsuit, the nail salon workers were fined for small infractions like gathering at the front desk or failing to record that a foot bath has been cleaned. The workers also allege they had their pay docked due to minor accidents, like breaking a nail polish bottle during the course of work, even if it was a customer’s fault.

"It is kind of crazy to be docked for your customers' dropping nail polish," said a representative from San Francisco-based watchdog group Asian Law Caucus. "It is a completely innocuous accident."

After talking to one another, the Natalie Salon workers eventually reached out to the watchdog group for help. The Asian Law Caucus representative says she believes at least 50 workers have been subjected to the same treatment at Natalie Salon locations throughout Northern California.

The nail salon workers are seeking class action certification and a jury trial.

I have been to Natalie Salon for many years. I know the owners they are immigrants too; they work so hard to do their best for their employees, they are so nice and treat their employees well, but only couple of them turn around to their employers. Even, they stole customers and open the nail shop across from Natalie Salon in Redwood City.
